1. GENERAL INFORMATION

These general sales conditions expressly regulate the relationships that arise between the Furniture Industry point of sale and customers who register as users or purchase products through the online store by completing the agreements established in the electronic purchase order.

The completion and sending of a purchase order expresses full knowledge and full and unreserved adherence to each of the general conditions.

The client affirms that he is of legal age and has the capacity to freely and voluntarily make a purchase order.

Sometimes, to facilitate better service, ownership of the sales management may be transferred to another company belonging to Furniture Industry, prior communication to the client and responding with the same level of guarantees and security.

ACCESS AND USE OF THE ON-LINE CHANNEL

The access and use of the online channel is free and free of charge.

For the purchase of products through the online store, Furniture Industry will ask users to proceed to register, having to fill in the electronic form following the instructions indicated therein. During the entire registration process, the client will provide only accurate and true data.

The username and password are enabling elements to access and make purchases and are confidential, personal and non-transferable. The username cannot be modified by the client, but the password can be changed by accessing "my account" within the website.

COMMUNICATIONS

Unless expressly authorized in writing by the owners in this regard, users may not manipulate, transform and use them for public disclosure or in an alleged commercial exploitation.

RETENTION OF TITLE

Furniture Industry and the companies responsible for the sale expressly reserve ownership of the goods sold until full payment of their price and other amounts that may accrue, considering that non-payment by one of the parties may cause a claim for the goods.

These provisions do not constitute any obstacle for the transfer to the client, from the delivery, of the risks of loss and deterioration of the acquired goods, as well as the damages that these could cause.

 2. PURCHASE OF PRODUCTS

The products offered on the website will be sent only to Spain. No shipments will be made outside the mentioned delivery area.

Furniture Industry reserves the right to remove or incorporate products without prior notice.

The photographs that appear are merely indicative and do not represent a contract at the time of purchase.

Unless expressly indicated, the price of the compositions and furniture displayed on the website does not include accessories, lights, mattresses, bed bases or decorative items.

The device from which the products are displayed may show slight variations in tone and color with respect to those received, especially if it is furniture made with natural raw materials (leather, marble, fabrics) or from orders from different suppliers or not done at the same time.

We will not be held responsible for errors made when selecting a measure or combination of modules. The characteristics and prices of the products are detailed in their file and the client declares to know the measurements, shapes and layout of those that make up their order in accordance with the specifications expressed in the store and the purchase order.

The measurement of certain products, especially sofas, mattresses or other upholstery, due to the special manufacturing characteristics and its components, may vary by +/- 5 centimeters per item.

3. PRICES AND AVAILABILITY

The prices shown include the legally applicable Value Added Tax (VAT) and are indicated in euros. Unless expressly stated otherwise, the prices indicated do not include shipping costs.

The client accepts that Furniture Industry will admit his request based on the available stocks and will do everything possible to respond to any request. In the event that a product is not available after confirming the order and after the closing of the corresponding sale, the customer will be informed of the partial delivery of his order or its cancellation.

In case of cancellation, any amount paid will be refunded according to the payment method made by the client or by transfer.

In the sale of products through promotions, customers may only request them during the period of validity of the offer and once the term has expired or their stocks have been exhausted, they will no longer be for sale.

4. SHIPPING COSTS AND FORMS OF PAYMENT

5. ORDERING AND DELIVERY

Once the duly completed purchase order is received, a confirmation of the order placed is sent to the email address indicated by the customer.

IMPORTANT: It is considered that the order begins its course when the payment is confirmed in the bank account or, in the case of financed payment, the final approval is received from the entity that grants the credit.

The delivery time is indicated in the product file and will range between 5 and 45 business days as a maximum period, and may vary depending on the delivery area. It will be computed by business days (Monday to Friday) from the moment in which the processing of your order becomes effective, after confirmation of payment.

Due to seasonality in the furniture and decoration sector, we inform thatbusiness periods are not consideredfor the production and transport of goods, those between December 23 and January 7, the days before Easter and practically the entire month of August.

In the event that various delivery terms appear in the same purchase order, it will be carried out jointly within the longer term of the products that make up your order.

For reasons of internal logistics, the same purchase may have partial shipments with different delivery dates.

If you want the delivery of an order in a later period than that indicated in the product sheet, you must notify it by mail to the email address of the establishment responsible for the sale upon receiving the order confirmation and the shipment will be made on the dates requested. Afterwards, the merchandise can only be retained in the warehouses for a maximum of 20 calendar days from the agreed delivery date and after this period there will be an additional monthly surcharge of 10% of the value of the order for storage expenses.

In case of non-compliance with the delivery date in more than 30 working days, the buyer may choose to cancel the order by registered letter with acknowledgment of receipt to the company responsible for the sale and obtain the amount paid according to the payment method used or Through transfer. Failure to deliver will not be considered such if it has been delayed by the buyer's own will or if it has not been possible to locate the buyer through the data provided.

Furniture Industry will not be responsible if the delivery of the order is not carried out on time due to force majeure or fortuitous events. In the same way, it will be released from the fulfillment of its delivery obligations provided for in these general conditions, declining all responsibility in this regard in the following cases:

  • Total or partial non-payment by the customer of the purchase order.
  • Inaccuracy of the data required from the client when completing the purchase order.
  • Impossibility of delivery of the order in the indicated place due to lack of adequate access or any other cause attributable to the client.

6. SHIPPING AND ASSEMBLY

The products offered on the website will be sent only to Peninsular Spain

No shipments will be made outside the mentioned delivery area.

Bulky products or products that require installation by professionals are delivered through our own personnel or specialized companies, including delivery to your home, placement in the chosen location, and removal of the packaging material.

The stay or room where the merchandise will be placed must be clear. The assembly commitment refers exclusively to the furniture purchased and does not include dismantling, moving or removing furniture that the client may have at home. The installation of all kinds of decorative accessories or the realization of any type of electrical connection will not be borne by Furniture Industry.

Deliveries are made from Monday to Friday (not holidays) in the morning or afternoon, having previously agreed the appointment with the client, who must verify the conformity of the order and the perfect condition of the merchandise.

If the delivery cannot be made on the agreed day due to the absence of the client or access difficulties not previously indicated, additional expenses equivalent to a new delivery will be generated and even a surcharge for storage costs that must be paid according to the market price.

If you wish to modify the previously agreed delivery date, you must notify us at least 72 hours in advance through the means provided by the transport company.

Certain products such as auxiliary furniture, decorative items or small elements resulting from incidents that do not require qualified installation, are delivered disassembled and are sometimes sent to the customer's address by express transport companies, without prior notification and without unpacking.

If the customer is not at home at that time, a notice will be left and the product will be held for 10 days to make a new delivery. After that period, the customer will bear the return costs.

In the event that defects are noticed at the time of receipt or installation of the purchased products, the anomalies must be clearly specified on the operator's delivery note and notified within a maximum period of 24 hours by sending an email to the company of the Furniture Group Industry responsible for the sale that you will find in the purchase confirmation. In this case, defective products will be repaired or replaced as soon as possible.

IMPORTANT: The assembly service will not be included in the shipping costs and if required, the client must request a quote through any channel ofcontact.

ACCESS

The customer must ensure that the dimensions of the purchased items will not cause accessibility problems to the property where the delivery is made through doors, corridors, elevators, landings, etc. and will warn of any difficulty that could prevent installation (walls plasterboard, floors in poor condition, etc.…)

The use of pulleys or similar mechanisms to raise or lower items on the facade of the building is not authorized.

If necessary, the contracting of mechanical means such as cranes or elevators, as well as their cost and risk, will be exclusively at the customer's expense and must be communicated in advance to coordinate the delivery.

In the same way, the client must inform, to solve possible problems, if the address is in an area of ​​difficult access for vehicles, within zones with limited loading and unloading hours or far from population centers. 

7. WARRANTY

The items purchased and related in this contract, based on Law 3/2014 that modifies Royal Legislative Decree 1/2007 on Guarantees in the sale of Consumer Goods, are guaranteed, in general, against any manufacturing defect or non-conformity for a period of two years from the date of receipt of each of them, recognizing the customer's right to repair the item, its replacement, the price reduction and the termination of the contract. After the sixth month, the purchaser must prove that the vices or defects detected had their origin on the date of delivery of the same.

To demand the guarantee, the presentation of the purchase invoice is required, as well as a detailed report of the defects, by email or registered letter to the address of the Furniture Industry company responsible for the sale. The guarantee will only be valid at the delivery address of the order and will lose its value if data on the invoice is altered, modified or replaced.

The guarantee does not cover displacement, nor deficiencies caused by negligence, blows, improper use or handling, incorrect installation not carried out by the authorized technical service or materials subject to wear due to normal use.

Certain normal characteristics of natural materials (veins, knots, marks on the skin...) are signs of authenticity and embellish a product, not being cause for complaint.

Visco-elastic mattresses or mattresses with a core made entirely of latex will not be valid for bases that do not allow perspiration and may not incorporate protectors or covers that prevent ventilation as they favor the appearance of moisture.

The Outlet section includes, among others, clearance items that are sold at a price below the usual price as they are manufacturing surpluses, from previous campaigns or from exhibition and that may present some type of tare clearly indicated on the product file. . These defects do not give the right to a warranty claim on them, the customer being aware of said anomalies and accepting them in exchange for an exceptionally low price.

This section is for the exclusive and independent treatment of each establishment of the Furniture Industry Group and its products are marketed through online sales only within the area of ​​influence of the indicated store.

RATES AFTER SALES SERVICES

The expenses that originate the repair of parts not attributable to Furniture Industry, will be borne by the client under the following rates, taxes not included.

8. RETURNS

8.1 Right of withdrawal

8.2 The right of withdrawal will not be applicable to contracts that refer to:

– The supply of goods that can deteriorate or expire quickly.

– The supply of goods that after delivery and taking into account their nature have been mixed inseparably with other goods.

– The supply of alcoholic beverages whose price has been agreed upon at the time of signing the sales contract and which cannot be delivered within 30 days, and whose real value depends on fluctuations in the

9. LAW

These General Conditions are governed by Spanish law and the parties submit, for the resolution of conflicts and waiving any other jurisdiction, to the Courts and Tribunals of the user's domicile.
